What is the impact of the ‘New Consumer Law’ on your online strategy?

Are you an (online) retailer with a strong focus on your rights and obligations vis-à-vis online marketplaces and consumers? Do you operate an online marketplace yourself? Then this session is a must for you!

Since May/June 2022, New Consumer Law rules have entered into force as a consequence of the EU Omnibus directive. The rise of e-commerce and its acceleration due to Covid have made it clear that consumer law was in need of a thorough update. Several updates were implemented, e.g.:

• Update of the consumer law rules for the new digital era, e.g. sales of software, music, digital services, etc.;
• Payments by consumers in the form of personal data;
• Update in the rules regarding price reductions and countering artificial price reductions (sales and fairs);
• Information obligations of online marketplaces, e.g. information/identification of the seller of the products (B2C and even C2C), indication whether consumer protection rules are applicable (which is not the case in C2C sales);
• A new list of prohibited commercial practices, including the use of false reviews;
• New sanctions up to 4% of the annual turnover;
• Etc.
